Remiten a juicio oral y público causa contra Wilmer Torres Urbina

La judicial Yelba Lino Macario juez de audiencias del Juzgado de Distrito penal de Juicios de Siuna, remitió a juicio oral y publico la causa por homicidio que se le lleva al joven Wilmer Torres Urbina, por el homicidio contra José Miguel Lara Ortiz, de 33 años, conocido como pililuca en Rosita Regio Autónoma de la Costa Caribe Norte.

El juicio oral y público del joven fue programado para el 6 de octubre a las 9:00 de la mañana, en medio de protestas que un grupo de personas llegaron desde Rosita para apoyar con pancartas y manifestaciones al acusado por considerar que es inocente.

Fulgencio Velásquez abogado de Wilmer Torres Urbina, dijo que se opuso a la decisión de la judicial porque no había suficientes elementos que prueben la vinculación del acusado en el crimen.

Esta el fiscal ofreció prueba él tenía que decirme con que pruebas va a sostener su acusación, para mí la prueba no es contundente, es limitada y es referencial, circunstancial que lo que acompaño el Ministerio Publico fueron objetos materiales obtenidos en la escena del crimen, así como objetos encontrados en la casa del acusado en días posteriores dijo el abogado.

El abogado dijo que los actos de investigación que se hicieron se enviaron a los laboratorios y se esperan los resultados de balística, químicos y balísticas que indiquen la participacion del acusado, por eso es referencial.

Fulgencio Velásquez dijo que el Ministerio Publico ofreció un video que está en las redes sociales, allí no se identifica claramente a nadie porque no se ve el rostro, allí se ven dos y acusaron a uno, tiene que quedar claro que según las versiones fueron dos que dispararon y los dos huyeron juntos del lugar.

Si eran dos los que participaron entonces debieron detener al conductor y como no se parece en nada lo dejan en libertad.

Para mí no debió remitir a unico porque no estaba sustentada la acusación y más bien debió enviar a al ministerio público para presentar pruebas más contundentes.

El abogado también pidió el cambio de media cautelar aduciendo que cuenta con un dictamen médico legal que prueba que el acusó padece de enfermedades crónicas y su salud está en peligro en las condiciones en que se encuentra en el penal de Siuna.

El dictamen dice que está gravemente enfermo y que está en peligro su salud, de allí es que la defensa solicito arresto domiciliario para que el acusado pueda tratarse en el hospital o la clínica donde ha tratado su enfermedad dijo el abogado.

Piden libertad

Mientras se desarrollaba la audiencia preliminar un grupo de personas procedentes de Rosita se presentaron en los alrededores del Juzgado de Distrito Penal, para demandar la liberta del joven Wilmer Torres Urbina.

El joven Wilmer Torres Urbina fue detenido el primero de agosto junto a Gesabel Jarquín Rodríguez quien ya está en libertad y las autoridades judiciales mantienen el proceso penal contra el joven Torres Urbina.

Varios pobladores dijeron que el joven Torres Urbina inocente y debe estar en libertad, porque tienen muchos años de conocerlo y también a su mama que es una maestra muy reconocida en ese municipio minero dijo Juana Benita Astacio, amiga del acusado.

Dani Rodríguez otro poblador de Rosita que llego a pedir la libertad del joven dijo que Torres Urbina es un hombre trabajador y de buena procedencia, desde que lo conozco ha sido una personas responsable y luchadora por su familia, todos los que andamos aquí somos testigos de su buen proceder del muchacho.

Wilmer Torres Urbina fue llevado al juzgado de audiencia a su audiencia preliminar en un Juzgado de Distrito Penal que estuvo bien resguardado por miembros de la Policía nacional para evitar desorden en el tribunal judicial de Siuna.

The lawyer also requested the change of the precautionary measure, arguing that he has a medical legal opinion that proves that the accused suffers from chronic diseases and his health is in danger under the conditions in which he is in the Siuna prison.

The ruling says that he is seriously ill and that his health is in danger, hence the defense requested house arrest so that the accused can be treated at the hospital or clinic where he has treated his illness, said the lawyer.

 They demand freedom for Rosita’s youth

While the preliminary hearing was taking place, a group of people from Rosita appeared in the vicinity of the Criminal District Court to demand the release of the young Wilmer Torres Urbina.

The young Wilmer Torres Urbina was arrested on August 1 along with Gesabel Jarquín Rodríguez, who is now at liberty and the judicial authorities continue the criminal proceedings against the young Torres Urbina.

Several residents said that the young Torres Urbina innocent and must be free, because they have known him for many years and also his mother, who is a well-known teacher in that mining municipality, said Juana Benita Astacio, a friend of the accused.

Dani Rodríguez, another resident of Rosita who came to ask for the release of the young man, said that Torres Urbina is a hard-working man of good origin, since I’ve known him he has been a responsible and fighter for his family, all of us who walk here are witnesses of his good boy behavior.

Wilmer Torres Urbina was taken to the hearing court for his preliminary hearing in a Criminal District Court that was well guarded by members of the National Police to avoid disorder in the Siuna judicial court.
