Abogado de Siuna suspendido por dos años por la Corte Suprema de Justicia
La Corte Suprema de Justicia (CSJ) de Nicaragua emitió a través de una circular donde se sentencia la suspensión del abogado Jimy Antonio López Castañeda al considerar que existen pruebas suficientes de haber actuado contra norma expresa legal y constitucional.
La circular publicada en la página oficial del Poder Judicial nicaragüense explica textualmente que las y los suscritos Magistrados miembros del Consejo Nacional de Administración y Carrera Judicial resuelven lo siguiente:
Ha lugar a la queja presentada, la procuraduría General de la República de Nicaragua en contra del abogado y notario Público Jimy Antonio López Castañeda:
De acuerdo al artículo 2 del Decreto Número 1618 se sanciona al Licenciado Jimy Antonio López Castañeda con suspensión en el ejercicio de Notario por un período de dos años a partir de la notificación de la presente resolución por existir pruebas suficientes de haber actuado contra norma expresa legal y constitucional.
Tomando en consideración los antecedentes comprobados en esta sentencia, se deja a salvo el derecho de la parte quejosa, para acudir a la jurisdicción competente para hacer valer sus derechos.
La misma circular afirma que se le ordena al Licdo. López la entrega de todos los protocolos notariales conformados desde la primera autorización que se extendiera este Supremo Tribunal para cartular libros notariales y el sello de abogado y notario público autorizado ante la Dirección de Registro y control de Abogados y Notarios Públicos.
Finalmente, se explica que cuando haya cumplido con la fecha de la sanción se le devolverán los protocolos y sellos depositados, y quedará habilitado automática, además, así como se publicó su suspensión, también se publicará en la página web del Poder Judicial su reintegro.
Asimismo, que se le notifique a los Registradores, Jueces, y Tribunales de toda la República y Gírese oficio a la Dirección General de Registro y control de Abogados y Notarios Públicos de este Supremo Tribunal con inserción de la parte resolutiva de la presente resolución, a fin de que se anote en el expediente que esa Dirección lleva el Licenciado Jimy López Castañeda.
Siuna’s lawyer suspended for two years by the Supreme Court of Justice
The Supreme Court of Justice (CSJ) of Nicaragua issued a circular ruling on the suspension of lawyer Jimy Antonio López Castañeda, considering that there is sufficient evidence of having acted against an express legal and constitutional rule.
The circular published on the official page of the Nicaraguan Judicial Power explains verbatim that the undersigned Magistrates, members of the National Council of Administration and Judicial Career, resolve the following:
The complaint filed by the Attorney General’s Office of the Republic of Nicaragua against the lawyer and notary Public Jimy Antonio López Castañeda:
According to Article 2 of Decree Number 1618, Attorney Jimy Antonio López Castañeda is sanctioned with suspension from the exercise of Notary Public for a period of two years from the notification of this resolution because there is sufficient evidence of having acted against express legal norm and constitutional.
Taking into consideration the proven antecedents in this judgment, the right of the complaining party is left safe, to go to the competent jurisdiction to enforce their rights.
The same circular states that Licdo. López the delivery of all notarial protocols formed from the first authorization issued by this Supreme Court to certify notarial books and the seal of attorney and authorized notary public before the Directorate of Registry and control of Lawyers and Notaries Public.
Finally, it is explained that when the date of the sanction has been met, the deposited protocols and stamps will be returned, and it will be automatically enabled, in addition, as well as its suspension, its reimbursement will also be published on the website of the Judicial Power.
Likewise, that the Registrars, Judges, and Courts of the entire Republic be notified and make official notice to the General Directorate of Registration and control of Lawyers and Notaries Public of this Supreme Court with insertion of the operative part of this resolution, to In order to write down in the file that that Directorate keeps, Mr. Jimy López Castañeda.
