Asamblea Nacional convoca a elección de magistrados CSE

El presidente de la Asamblea Nacional, doctor Gustavo Porras, anunció este jueves que a partir del lunes 12 de abril se abre convocatoria para la presentación de candidatos y candidatas al cargo de magistrados del Consejo Supremo Electoral.

Asimismo, indicó que se aprobó la creación de una Comisión Especial de Carácter Constitucional para Asuntos Electorales, la cual está presidida por la diputada María Auxiliadora Martínez y conformada por los legisladores Edwin Castro, Irma Dávila, Jenny Martínez, Wálmaro Gutiérrez, Rosa Argentina Navarro y Mario Ascencio.

Porras agregó que las resoluciones serán presentadas en una sesión plenaria el próximo lunes 12 de abril para ser aprobada y posteriormente publicada en la Gaceta Diario Oficial.

Después el presidente Daniel Ortega y los diputados tendrán la facultad de presentar sus candidatos o candidatas a los cargos antes mencionadas en un plazo de 15 a partir de la publicación.

¿Qué dice la Constitución Política De Nicaragua?

El Artículo 170 señala que el Consejo Supremo Electoral estará integrado por siete Magistrados propietarios y tres suplentes, elegidos por la Asamblea Nacional, de conformidad con las disposiciones contenidas en el numeral 8) del artículo 138. Los miembros del Consejo Supremo Electoral elegirán de entre el os al Presidente y Vicepresidente del mismo. Su período será de un año, pudiendo ser reelegido.

Mientras el artículo 171 agrega que para ser Magistrado del Consejo Supremo Electoral se requiere: 1) Ser nacional de Nicaragua. En el caso de quien hubiere adquirido otra nacionalidad deberá haber renunciado a el a al menos cuatro años antes de ser electo para el cargo. 2) Estar en pleno goce de sus derechos civiles y políticos. 3) Haber cumplido treinta años de edad y no ser mayor de setenta y cinco años al día de la elección. 4) Haber residido en forma continuada en el país los cuatro años anteriores a su elección, salvo que durante dicho período cumpliere misión diplomática, trabajare en organismos internacionales o realizare estudios en el extranjero.

Además No podrán ser Magistrados del Consejo Supremo Electoral: a) Los parientes dentro del cuarto grado de consanguinidad o segundo de afinidad de los candidatos a Presidente y Vicepresidente de la República. En el caso de que ya se encontrase electo antes de las elecciones presidenciales, estará implicado y por tal razón inhibido de ejercer, durante todo el proceso electoral, debiendo incorporar a su suplente. b) Los que ejerzan cargos de elección popular o sean candidatos a algunos de el os. c) Los funcionarios o empleados de otro Poder del Estado en cargos retribuidos con fondos fiscales, regionales o municipales, salvo en lo relacionado al ejercicio de la docencia o la medicina. d) El militar en servicio activo, o el que ya no siéndolo no hubiere renunciado por lo menos doce meses antes de la elección. e) (derogado).

National Assembly calls for the election of CSE magistrates

The president of the National Assembly, Dr. Gustavo Porras, announced this Thursday that as of Monday, April 12, a call will be opened for the presentation of candidates for the post of magistrates of the Supreme Electoral Council.

What does the Political Constitution of Nicaragua say?

Article 170 indicates that the Supreme Electoral Council will be composed of seven proprietary Magistrates and three alternates, elected by the National Assembly, in accordance with the provisions contained in paragraph 8) of Article 138. The members of the Supreme Electoral Council will choose from among the to the President and Vice President of the same. His term will be one year, and he may be reelected.

While article 171 adds that to be a Magistrate of the Supreme Electoral Council it is required: 1) To be a Nicaraguan national. In the case of those who have acquired another nationality, they must have renounced it for at least four years before being elected to the position. 2) To be in full enjoyment of their civil and political rights. 3) To have reached thirty years of age and not be older than seventy-five years on the day of the election. 4) To have resided continuously in the country for the four years prior to his election, unless during said period he was on a diplomatic mission, worked in international organizations or studied abroad.

In addition, the following may not be Magistrates of the Supreme Electoral Council: a) Relatives within the fourth degree of consanguinity or second degree of affinity of the candidates for President and Vice President of the Republic. In the event that he is already elected before the presidential elections, he will be involved and, for this reason, inhibited from exercising, throughout the electoral process, having to incorporate his alternate. b) Those who hold positions of popular election or are candidates for some of them. c) Officials or employees of another Power of the State in positions paid with fiscal, regional or municipal funds, except in relation to the exercise of teaching or medicine. d) The military man on active duty, or the one who is no longer so, has not resigned at least twelve months before the election. e) (repealed).
