Primer juicio por crímenes de odio en el Caribe Norte

Luis Evelio García Estrada de 28 años de edad, acusado de femicidio en concurso real con el delito de asesinato agravado en perjuicio de Jessica del Carmen Guido Chévez, de 21 años de edad y de su hijito de apenas 15 meses de edad, ocurrido el pasado 29 de mayo en la comunidad Wasminona, municipio de Rosita, Caribe Norte, admitió los hechos a pocos minutos de ser presentado ante la jueza de Distrito Penal Especializada en Violencia de Siuna , Jazohara Zamora Rivera.

García Estrada se convierte en la primera persona en ser juzgada con la ley de prisión perpetua en la Costa Caribe y en la tercera a nivel nacional, en ningún momento mostró arrepentimiento alguno por el crimen lleno de odio y misoginia que refleja claramente el odio hacia la mujer y los más vulnerables, el cual cometió en la víspera al día de las madres …“estaba enojado y se me metió el diablo, pero no me arrepiento” … dijo en parte su admisión de hechos, al salir de los juzgado desafió diciendo que si volvería a nacer lo volvería hacer.

Ni un mes fuera de la casa de su papá

Jessica del Carmen era originaria de la comunidad Las Quebradas del municipio de Siuna, donde habitaba en casa de su papá junto a su verdugo, quien luego de tanta insistencia la convenció a mudarse a Rosita justificando que trabajaría como güirisero, por lo que el pasado 30 de abril salieron rumbo a ese municipio, sin imaginar que la intensión de este era aislarla del seno familiar y colocarla junto a su bebe en un nivel de vulnerabilidad, para tener total control sobre su vida, mediante el abuso de poder, por la dependencia emocional y económica, señala la acusación.

La acusación agrega, que en el período del 18 al 29 de mayo, la víctima y su verdugo permanecieron en el barrio Meyling Onsang del municipio de Rosita, donde existe un punto de minería artesanal, donde el acusado había conseguido trabajo, durante este tiempo celaba a la víctima con el resto de trabajadores y le amenazaba constantemente, …“expresándole que si lo abandonaba, no iba a gozarla nadie más, que si no era de el, no iba a ser de nadie, motivo por lo cual la víctima Guido Chévez, atemorizada pretendía separarse del acusado, pero este al tener sospechas de la decisión de tomaría… planificó privar de la vida a las víctimas y así cumplir sus amenazas”, detalla la acusación.

Saña, odio y crueldad

A eso de las 10:00 Am Luis Evelio condujo a su víctima rumbo a la comunidad Wasminona, pero desvió su camino a un punto de minería artesanal donde prestó un machete al vigilante de la propiedad, justificando que lo usaría para cortar leña y que posteriormente lo devolvería, acto seguido siguió su marcha, pero a eso de las doce del medio día, nuevamente cambió su ruta y esta vez tomó el camino que conduce a la comunidad El Paraiso, luego de 150 metros hacía al noreste le propinó tres machetazos que dejaron el cuerpo de la mujer destrozado en presencia de su pequeño hijo, a quien posteriormente le propinó dos machetazos que también destrozaron el cuerpo del niño y que le ocasionaron la muerte.

El cuerpo del niño fue arrojado a un barranco ubicado a unos 9 metros hacía el costado este del lugar donde fue asesinado cruelmente, mientras que el cuerpo de su madre fue arrojado a otro barranco, a una distancia de 16 metros hacia costado este del camino, quedando semi desnuda, acto seguido ocultó el machete y se dio a la fuga.

García Estrada fue capturado por la Policía Nacional el pasado jueves 3 de junio en la comunidad Asturias No 2, municipio de Jinotega y recibirá su condena el próximo 09 de junio a las 2:30Pm, su defensa pidió la pena de 30 años que hasta el 19 enero que entró en vigencia la Ley de Prisión Perpetua, era la pena máxima en el país, pero el Ministerio Publicó a través del fiscal César Calonge, solicitó a la judicial la cadena perpetua.

De acuerdo a la ley, la cadena perpetua fue creada para “crímenes de odio”, será revisable, y aplicará “excepcionalmente” a “las personas condenadas por delitos graves, cuando concurran circunstancias de odio, crueles, degradantes, humillantes e inhumanas, que por su impacto causen conmoción, rechazo, indignación, repugnancia, en la comunidad nacional”.

Not a month away from his dad’s house

Jessica del Carmen was originally from the Las Quebradas community in the Siuna municipality, where she lived in her father’s house with her executioner, who after so much insistence convinced her to move to Rosita, justifying that she would work as a güirisero, so last 30 April, they left for that municipality, without imagining that the intention of this was to isolate her from the family bosom and place her next to her baby in a level of vulnerability, to have total control over her life, through the abuse of power, due to emotional dependence and economic, indicates the accusation.

The accusation adds that in the period from May 18 to 29, the victim and his executioner remained in the Meyling Onsang neighborhood of the Rosita municipality, where there is an artisanal mining point, where the accused had found work, during this time he was jealous. the victim with the rest of the workers and constantly threatened him,… “expressing to him that if he left him, no one else would enjoy it, that if it was not his, it would not belong to anyone, which is why the victim Guido Chévez , frightened, she tried to separate from the accused, but when he was suspicious of the decision he would take … he planned to deprive the victims of their lives and thus carry out his threats, ”the accusation details.

Viciousness, hatred and cruelty

At around 10:00 am Luis Evelio led his victim to the Wasminona community, but diverted his way to an artisanal mining point where he lent a machete to the property guard, justifying that he would use it to cut firewood and that later He would return it, then he continued his march, but at around twelve noon, he changed his route again and this time he took the path that leads to the El Paraiso community, after 150 meters to the northeast he gave him three machetes that left the woman’s body destroyed in the presence of her young son, who was later hit with two machetes that also destroyed the child’s body and caused his death.

The boy’s body was thrown into a ravine located about 9 meters to the east side of the place where he was cruelly murdered, while the body of his mother was thrown into another ravine, at a distance of 16 meters to the east side of the road. remaining semi naked, she immediately hid her machete and fled.

García Estrada was captured by the National Police last Thursday, June 3 in the Asturias No 2 community, Jinotega municipality and will receive his sentence on June 9 at 2:30 p.m., his defense requested the 30-year sentence that until the On January 19, when the Perpetual Prison Law came into force, it was the maximum penalty in the country, but the Ministry published through the prosecutor César Calonge, asked the court for life imprisonment.

According to the law, life imprisonment was created for “hate crimes”, it will be reviewable, and it will apply “exceptionally” to “persons convicted of serious crimes, when there are hateful, cruel, degrading, humiliating and inhuman circumstances that by their impact they cause shock, rejection, indignation, disgust, in the national community ”.
